The Après Vélo Hobart Half Day Cycling Tours are subject to the terms and conditions listed below. By booking your trip and paying a deposit, you confirm that you are over the age of 18 and have read, understood, and accept these terms and conditions in their entirety.


1. Medical and Health Information

All guests need to be in good physical health in order to participate on this half day tour. Please make sure you have read through the ride itinerary carefully and assess your ability to cope. Please note that if, in the opinion of our group leader or local guide, any participant is unable to complete the ride without undue risk to themselves and/or the rest of the group, Après Vélo reserves the right to exclude them from all or part of the ride without refund.


2. Price

The prices displayed online include taxes where applicable and are the agreed price to be paid in full at the time of booking.


3. Payment

3.1 Upon receipt of your Booking Form, we will make contact with you to confirm the status of your booking and finalise any additional information we may require. Thereafter we will issue you with an invoice for payment. We accept payment by credit card, Paypal or bank transfer. Upon receipt by us of your payment, your booking becomes confirmed, and notification will be provided to you in this regard.

3.2 If payment is made by credit card, a surcharge will be added to the total price. The current surcharge for all credit cards is 1.8% of the total price.

3.3 If payment has not been received, Après Vélo reserves the right to cancel your booking.


4. Cancellations by the Customer

4.1 Should you need to cancel your trip for whatever reason, please give us notice by emailing cyclingnuts@apresvelo.com, after which we will confirm your cancellation with an email.

4.2 Charges – Unless otherwise agreed by Après Vélo and the Customer in writing, the following cancellation charges are payable by the Customer based on the number of days prior to the Tour commencement date.

• 91 days or more: receive a refund of all payments already made.
• 90 – 31 days prior: refund of 25% of payments already made.
• 30 – 0 days prior: No refund available.


5. Force Majeure

“Force Majeure Event” means unusual and/or unforeseeable events, beyond the control of Après Vélo or the Suppliers, that affect the ability of Après Vélo to provide the Services or the ability of the Suppliers to provide Products, including, but without limitation, acts of God, flood, drought, earthquake, extreme weather or other natural disaster, epidemic, pandemic or significant risk to human health such as the outbreak of disease (including but not limited to COVID-19 and any disease caused by a new strain of the coronavirus), terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations, nuclear, chemical or biological contamination or sonic boom, any law, guidance or advice issued, or any other action taken by a government (local or national) or port, border, river and/or aviation authority (local or national) or other public authority, collapse of buildings, fire, explosion or accident, or interruption or failure of utility service.


6. Trip Modifications/Alterations/Cancellations by Après Vélo

6.1 We reserve the right to cancel or alter your trip at any time prior to your departure date or during the trip, due to Force Majeure events outside of our control. In such event, Après Vélo will not be responsible for any refunds, damages incurred, or compensation claims whatsoever. It is therefore a requirement that you take out appropriate insurance to protect and cover you against such eventualities occurring.

6.2 We also reserve the right to cancel or alter your trip at any time based upon insufficient bookings being received, prior to the Tour commencement date (at our discretion), although we assure you that we will only do this when strictly necessary and will inform you immediately of any such alterations. In the event of such a cancellation, Après Vélo will issue a full refund of any amounts paid.

6.3 We reserve the right to make route modifications which may become necessary due to circumstances beyond our control and undertake to inform participants as soon as possible.

 

7. Obligations, Responsibility and Liability

7.1 Our rides can be physically active, with varying levels of demands and fitness requirements depending on the specific itinerary. By agreeing to these terms, you represent that you do not have any physical or other conditions that would create a hazard for you or other Participants or affect other people’s enjoyment of the tour. Après Vélo assumes no responsibility for any medical care provided to you. You agree to be responsible and pay for all costs of medical care and related transportation that are provided to you during the tour.

7.2 You must strictly comply with all local laws, respect local customs and culture, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During the tour, Après Vélo or the local guide/supplier has the right in its sole discretion to remove anyone a) who it judges to be incapable of meeting the demands and requirements of participating in the tour activities; or b) who it determines to detract from others’ enjoyment of the tour.

 

8. Other Responsibilities

You shall:

  1. Sign waiver form prior to commencement of the trip.
  2. Ensure you are of an appropriate level of fitness to participate in our tour.
  3. Follow the instructions of our professional ride guides at all times.
  4. Wear a helmet at all times whilst cycling.
  5. Not cycle when under the influence of alcohol or drugs.
  6. Obey all road rules and regulations both on and off the bike.
  7. Respect other road users who are not involved in the tour.


9. Rental Bikes/Maintenance

If you rent a bike for this trip, you are responsible ensuring it is well maintained and remains in good condition. You shall be responsible for returning it in the condition you hired it or as agreed with the third-party supplier you hired it from.

 

10. Waiver

Prior to the commencement of the trip, you are required to sign this waiver form.

Furthermore, Après Vélo is not liable for personal injury, death, damage to property or other loss whether arising from accident, cancellation, delays or any other matter beyond our control.


11. Liability

We shall not be liable to you for any: loss of, or damage to, your property caused by your own act or omission; claim for disappointment; or claim for loss of enjoyment; or loss incurred as a result of Events Outside of Our Control; or loss incurred due to the theft of bicycles; or loss incurred due to injury as a result of cycling either on or off road, or loss related to any business of yours such as lost data, lost profits, loss of business, loss of contracts, loss of goodwill or other business loss that you may incur as a result of any breach of these terms and conditions; or other special, indirect or consequential losses.
If you have any concerns while on your tour, please communicate those concerns directly with your Après Vélo guides and allow us to address them immediately.


12. Protection of Personal Information

We will use the personal information you provide to us to process your payment for your trip and inform you about similar products or services that we provide. We will not give your personal data to any other third party.


13. Photography or Recording During Travel

13.1 By making a Booking with Après Vélo, Customers agree to allow their images and/or voice to be used for promotional purposes in photographs, video and recordings.

13.2 Customers who prefer that their images and/or voice not be used are asked to identify themselves to an Après Vélo representative at the beginning of their tour.

 

14. Governing Law

These Conditions are governed by and are to be construed in accordance with the laws of the State of NSW and Australia.

 

15. Miscellaneous

15.1 Après Vélo’s failure to enforce any of these Conditions shall not be construed as a waiver of any of Après Vélo's rights.

15.2 If any Condition is unenforceable, it shall be read down to be enforceable or, if it cannot be read down, the condition shall be severed from the Conditions without affecting the enforceability of the remaining conditions.

15.3 Après Vélo reserves the right to correct any errors or omission in its published materials and to amend these Terms and Conditions at any time.
